De facto Visa
De facto visas are one of the most common visa applications that our firm lodges. Some couples opt for a de facto visa and we will assess your eligibility prior to lodging your visa. Due to the marriage laws in Australia, same sex couples cannot do a marriage visa and must do a de facto visa application. De facto visas make up less than 11% of partner visa applications and are the most difficult of the 3 types of partner visas to have approved.
De facto visas have a tricky element to them as the “12-month rule” is applicable, which means you need to prove you have been in a relationship with your partner for 12 months PRIOR to the lodgement of your visa. There are ways around this requirement though in some instances, and we can guide you through this process if you are eligible.
The good news is that the 2 yr period that you are required to hold your visa for, commences from the date of application, not the date of grant.
